Ineligibility & Exclusionary Criteria

Exclusion Factors

You are not eligible for the Drug and Treatment Court program if:

  • You are charged with a violent crime.
  • You are currently under parole supervision.
  • You are not a Wayne County resident.
  • You are serving a sentence of incarceration for another sentence.
  • You have another charge pending of which you would be deemed ineligible.
  • You have committed in your past: 
    • Aggravated assault
    • Arson
    • Burglary with a firearm
    • Burglary with a person present
    • Drug trafficking
    • DUI with death or serious bodily injury
    • Human trafficking
    • Inchoate crimes to the within listed offenses
    • Kidnapping
    • Manslaughter
    • Rape
    • Robbery
    • Sexual offense under chapter 31
    • Simple assault (may be considered on a case-by-case basis)
    • Statutory rape
    • Strangulation
    • Weapons offense under chapter 61
    • Murder
